Welcome to namepop.net, a private, invitation-only social platform owned and operated by Meramec Entertainment, LLC ("we," "us," or "our"). Our goal is to maintain a positive, respectful, and safe space for adults and supervised youth members aged 13 and older, with a focus on the independent music community. These Community Guidelines outline the expectations for all members to ensure everyone can enjoy a supportive environment. By accessing or using namepop.net, you agree to abide by these Guidelines, our Terms of Use, and our Privacy Policy. Violation of these Guidelines may result in content removal, account suspension, or termination at our sole discretion.

These Guidelines are not exhaustive and should be read in conjunction with our Terms of Use, which include additional rules on intellectual property, licensing, and liability. We reserve the right to enforce these Guidelines as we deem necessary to protect the community.

1. Be Respectful

Treat all members with courtesy and dignity. We do not tolerate:

  • Harassment, bullying, intimidation, or stalking
  • Insults, name-calling, demeaning behavior, or discrimination based on race, ethnicity, gender, sexual orientation, religion, disability, or any other protected characteristic
  • Targeting individuals or groups with hateful, inflammatory, or harmful language
  • Doxxing or any form of unwanted exposure

If you disagree with someone, express your views respectfully and constructively. We encourage positive interactions that foster community growth.

2. Keep the Community Safe

Safety is our highest priority. Members may not:

  • Encourage, promote, or depict self-harm, suicide, violence, or harm toward others
  • Share threats, coercive, manipulative, or extortionate behavior
  • Post content that could endanger minors, including grooming, exploitation, or inappropriate interactions
  • Promote or engage in illegal activities, such as drug use, underage drinking, or criminal conduct
  • Impersonate others or create false identities to deceive

We reserve the right to remove content or accounts that compromise community safety, and we may report illegal activities to authorities as required by law.

3. Protect Privacy

As a private network, respecting privacy is essential. Do not:

  • Share someone else’s personal information, including contact details, photos, or location without explicit permission
  • Post private conversations, messages, or screenshots without all parties' consent
  • Attempt to access, hack, or interfere with another member’s account or data

Parents or guardians of youth members (aged 13–16) may review their child’s activity as provided in our Privacy Policy and Terms of Use. You agree not to circumvent any privacy settings or controls.

4. Share Responsibly

We encourage creativity, music sharing, and positive connections, but all content must align with our safe-community mission. Not allowed:

  • Explicit, pornographic, or adult-oriented content
  • Graphic, violent, gory, or disturbing material
  • Promotion of illegal activities, harmful substances, or dangerous behaviors
  • Spam, scams, fraudulent schemes, or misleading promotions
  • Content that violates laws, including defamation, libel, or invasion of privacy

Allowed:

  • Original music, art, photos, videos, and posts that reflect positive, respectful engagement
  • Creative expression that complies with these Guidelines and our Terms of Use

You are solely responsible for your content. We do not endorse or verify user posts.

5. Youth Member Protections

For members aged 13–16, additional safeguards apply to ensure compliance with laws like COPPA:

  • No targeted or behavioral advertising
  • No precise geolocation tracking
  • Verifiable parental consent required for membership and data collection
  • Parents or guardians may review, delete, or revoke consent for their child’s information at any time, leading to immediate account termination if revoked

Youth members must follow all Guidelines and are expected to behave responsibly. Interactions with minors must be appropriate; any suspicious activity will result in immediate investigation and potential termination.

6. Respect Intellectual Property

Only share content you own or have explicit permission to post. This includes:

  • Music, audio recordings, and compositions
  • Photos, artwork, and images
  • Videos and multimedia
  • Written content, quotes, or derivatives

Do not upload or share infringing material, such as unauthorized samples, covers without licenses, or copyrighted works. We comply with the Digital Millennium Copyright Act (DMCA) and may remove content that appears to violate copyright, trademarks, or other intellectual property rights. Refer to our Terms of Use for details on DMCA notices, user warranties, and indemnification.

You agree to indemnify us for any claims arising from your content's IP violations.

7. No Spam or Misuse

To keep the community clean and enjoyable:

  • No mass-messaging, chain letters, or unsolicited promotions
  • No fake, duplicate, or bot accounts
  • No deceptive links, malware, or phishing attempts
  • No unauthorized data collection or scraping
  • No use of automated tools, scripts, or bots for posting, liking, or interacting

We remove spam immediately and may suspend or terminate accounts involved in misuse.

8. Enforcement and Consequences

Membership on namepop.net is a privilege, not a right. We may, at our sole discretion and without prior notice:

  • Remove or edit content
  • Suspend or terminate accounts
  • Restrict access to features

Grounds for action include, but are not limited to:

  • Violating these Guidelines
  • Threatening community safety or integrity
  • Attempting to bypass moderation or technical protections
  • Misrepresenting age, identity, or parental consent
  • Repeat offenses or severe violations

We act quickly when safety is at stake and may cooperate with law enforcement if necessary. Decisions are final and not subject to appeal.

9. Report Concerns

If you see something that violates these Guidelines, report it promptly through the Contact Us page or in-app reporting tools. We review all reports confidentially and take appropriate action. False or abusive reports may result in your account being reviewed.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MERAMEC ENTERTAINMENT, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, USER CONTENT, OR ANY VIOLATIONS OF THESE GUIDELINES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY. OUR TOTAL LIABILITY SHALL NOT EXCEED $100. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Governing Law & Dispute Resolution

These Guidelines are governed by the laws of the State of Missouri, without regard to conflict of law principles. Any disputes arising from or relating to these Guidelines shall be resolved through binding arbitration in Branson, Missouri, administered by the American Arbitration Association under its Commercial Arbitration Rules. You waive any right to participate in class actions. If arbitration is unavailable, disputes shall be resolved in the state or federal courts in Taney County, Missouri.

12. Severability & Updates

If any provision of these Guidelines is held invalid or unenforceable, the remaining provisions will remain in full force. We may update these Guidelines as our community evolves or laws change, with notice via the platform. Continued use constitutes acceptance. We encourage members to review them periodically.
